Terms and Conditions

1. The Merchant shall indemnify and hold the Carrier harmless against any and all claims, losses, or damages arising from the conduct of the Merchant (including its officers, directors, employees, agents, or owners) that constitutes a violation of the Merchant’s obligations, representations, warranties, and covenants contained herein.

2. Any additional costs or fines caused by the Merchant such as penalties imposed by authorities, detention charges, claims for damaged containers, or port storage charges shall be paid separately.

3. Transit times are provided as per information from Vessel Operators. The Carrier is not responsible for delays; however, we assure you that every effort will be made to deliver cargo on time.

4. The Carrier shall not be liable for any failure to perform its obligations under this contract if such failure results from circumstances beyond their reasonable control, including but not limited to acts of God, fire, flood, earthquake, or other natural disasters, war, riot, insurrection, or civil commotion, strikes or lockouts, pandemics or epidemics ,government orders or restrictions etc.. 

The Carrier will use reasonable efforts to mitigate the effects of the event and resume performance as soon as possible. If the force majeure event continues for more than 14 days, the Carrier may terminate this Contract upon written notice.

The Merchant shall bear the applicable additional costs incurred if any during the Force Majeure period..

5. Insurance is the responsibility of the Merchant; the Merchant shall insure their own goods.

6. The liability of the Carrier, if established, shall not exceed the declared value of the goods at the time of import/export.
